TERMS OF SERVICE – STAYWISE PROGRAM
Terms of Service – StayWise Program
Effective Date: January 1st, 2025
By subscribing to StayWise, a service provided by StayWise, LLC ("StayWise"), you ("Client") agree to the following Terms of Service ("Terms"). These Terms govern your use of the StayWise program and all related services.
1. Subscription & Payment Terms
1.1 Subscription Selection: By subscribing, Client agrees to enroll in the selected plan:

- [ ] Growth Plan
- [ ] Pro Plan
1.2 Payment Schedule: Payments are due on a monthly basis from the date of your original subscription.
1.3 No Chargebacks Allowed: Clients agree not to file chargebacks. A $150 dispute fee applies for any chargeback filed.
1.4 Late Payments & Collections: Payments that are 30 days late may be sent to collections.
1.5 Late Fees & Subscription Hold: If payment is missed or late, a $50 per day fee applies. Clients cannot cancel their subscription while a balance is due.
1.6 No Refunds: All payments are final and non-refundable.
1.7 Client Responsibility for External Fees: Clients must pay for any PMS software (e.g., OwnerRez, Guesty), pricing tools, or services needed for listing management.
2. Data Access & Client Obligations
2.1 StayWise’s Data Rights: StayWise retains the right to access all booking, financial, and client data for optimization purposes.
2.2 Client Cooperation: Clients must provide necessary credentials, financial details, and property data.
3. Service Scope & Limitations
3.1 Scope of Services: StayWise provides listing optimization, revenue management, and consulting based on the selected plan.
3.2 No Guarantee of Revenue: StayWise does not guarantee bookings or revenue increases.
3.3 No Liability for Listing Errors: StayWise is not responsible for revenue loss, pricing fluctuations, or platform errors.
4. Confidentiality & Data Security
4.1 Confidentiality: Information shared between StayWise and Client remains confidential and cannot be disclosed without written consent.
4.2 Data Protection: While StayWise takes security measures, we are not liable for unauthorized access or data breaches.
5. Cancellation & Liability
5.1 No Subscription Cancellation While Balance is Due: Clients cannot cancel with an outstanding balance.
5.2 Non-Payment Consequences: StayWise reserves the right to pursue legal action and collections.
5.3 Liability Limitation: StayWise is not responsible for indirect, incidental, or consequential damages.
5.4 Cancellation Policy: Clients must provide 60 days written notice before canceling their subscription. All outstanding fees must be paid before termination is processed.
6. Governing Law & Final Terms
6.1 Governing Law: This agreement is governed by the laws of California and the Client’s state.
6.2 Entire Agreement: These Terms constitute the full agreement between StayWise and Client.
6.3 Agreement to Terms: By subscribing, the Client confirms that they have read and agreed to these Terms.
By completing your subscription, you confirm that you have read and agreed to these Terms of Service.
